1. conclusion of the contract:

By registering for an offer of the German Football Academy (hereinafter referred to as the provider), the customer offers to conclude a contract with the provider. The registration can be made by post, internet or e-mail. It is also made for all participants listed in the registration, for whose contractual obligations the registrant is liable as for his own obligations. The contract is concluded with the binding registration.


2. services:

The scope of the contractual services is set out in the provider's description of the programme in brochures and on the Internet at www.dfa-web.de, as well as in the details in the confirmation of participation.


3. changes in services and prices:

Changes or deviations of individual services from the agreed content of the contract, which become necessary after conclusion of the contract and which were not brought about by the provider contrary to good faith, are only permitted insofar as the changes or deviations are not significant and do not affect the overall course. If the registration for a course of the German Football Academy is made within a period of two weeks before the start of the event, the provider can no longer guarantee a timely delivery of the equipment to the venue.


4. payment:

Upon receipt by the provider of the fully completed registration form signed by the parent or legal guardian, the customer shall receive a confirmation of participation (by post, fax, e-mail), which shall also be regarded as an invoice. The participation fee must then be transferred within 10 days to the account stated in the confirmation of participation. Upon receipt of the payment amount, the participation place is secured. If no payment is made within the aforementioned time frame, the right to a participation place reservation expires.


5. withdrawal:

The client may withdraw from the contract at any time. The withdrawal can only be declared in writing. If the customer withdraws from the contract or does not take up the offer, the provider can demand lump-sum withdrawal costs in accordance with § 651i paragraph 2 BGB (German Civil Code) as reasonable compensation for the arrangements made and for his expenses. These flat-rate cancellation costs are as follows per registered participant: In the event of cancellation up to six weeks before the start of the course, 20.00 euros will be charged as a processing fee. In the event of cancellation up to three weeks before the start of the course, 30 % of the participation fee will be charged. If a cancellation is made within the last three weeks before the start of the course, 50 % of the participation fee is due. In the event of cancellation 14 days to 1 day before the start of the course, 80 % of the participation fee is payable. In the event of cancellation on the 1st day of the course, the full participation fee must be paid. If the course participation is cancelled, for whatever reason, there is no right to a refund. All claims against the organiser are extinguished with the cancellation or discontinuation.


6. performance:

For the duration of the service provided by the German Football Academy, the legal guardians transfer the supervisory duties and rights to the event manager of the German Football Academy, who in turn may transfer these to his staff. The participants must follow the instructions of the coaches of the German Football Academy. If their instructions are not followed, the event manager of the course or his authorised representative has the option of excluding the participant from the training or event. There is then no entitlement to a refund of the amount paid. The implementation of the service offered is the sole responsibility of the respective event manager of the German Football Academy, his/her authorised representatives or the office of the German Football Academy.

7. information on state of health:

Participants must be in good health and fully able to perform sports and complete the training programme without any restrictions. The parents or legal guardians of the participant undertake to inform the respective manager or his authorised representative of all health impairments of their child (in writing/verbally), including any medication, when registering (in writing) and at the start of the respective service of the German Football Academy. Changes in the participant's state of health during a German Football Academy event must be reported immediately to the respective German Football Academy event leader or his/her representative and may lead to exclusion from the F German Football Academy service.


8. Withdrawal and termination by the provider:

The provider may withdraw from the contract before the start of the event or terminate the contract after the start of the event in the following cases:
a. Up to 2 weeks before a course (event) of the German Football Academy. If a course (event) is cancelled by the host club or the German Football Academy because the minimum number of participants has not been reached, the customer will be offered a replacement event. If the host is unable to offer the customer a replacement event, the customer shall be refunded the entire participation fee. If the customer refuses to take part in the replacement event, the entire participation fee shall be refunded.

b. Compliance with the rules for courses/offers of the German Football Academy: The provider reserves the right to send the participant home at his/her own expense in the event of non-compliance with the rules (e.g. drug and alcohol consumption, vandalism, ect.).


9 Liability of the provider:

The provider is liable within the scope of the duty of care of a prudent businessman for:

1. conscientious preparation

2. the careful selection and supervision of the service providers

3. the correctness of the description

4. the proper provision of the contractually agreed services.

 

The German Football Academy accepts no liability for cancellations of the services offered due to weather conditions or other reasons, or for course participants not being able to participate due to illness, holidays or other reasons. In principle, there is no entitlement to reimbursement or replacement of cancelled training hours. Any insurance is the responsibility of the participants. The German Football Academy accepts no liability for damage or injury to itself or third parties. The German Football Academy is expressly not liable for damage to the path and damage to the respective facilities of the training opportunities and for damage of any kind before, during and after its services.


10 Limitation of liability:

A claim for damages against the provider is limited or excluded to the extent that, due to statutory provisions applicable to the services to be provided by a service provider, a claim for damages against the service provider is only excluded under certain conditions. Furthermore, no liability exists in the event of burglary or theft.


11. insurances:

Each participant must have health and liability insurance, children and young people through their legal guardians. The conclusion of further insurances is at the discretion of the participants.


12. medical care:

If a participant becomes ill or injured during the event, the participant or his/her legal guardian authorises the provider to take all necessary steps and actions for his/her safe, appropriate treatment and/or transportation home. If any costs are incurred by the Provider as a result of emergency medical treatment of a Participant, the Participant or his/her legal guardian(s) agree(s) to reimburse the Provider promptly.

13. photo and film rights:

With the registration, the participants and their legal representatives declare their consent to the fact that pictures and film recordings of the participants are made and distributed and publicly displayed by the provider, the German Football Academy , as well as the advertising agencies commissioned by the German Football Academy with the implementation - also on the Internet - without restriction of the spatial, content-related or temporal area of use and in particular repeatedly also for purposes of their own or third-party advertising as well as for merchandising purposes.


14 Jurisdiction:

The participant may only sue the provider at the provider's registered office. The place of residence of the participant is decisive for lawsuits of the provider against the participant, unless the lawsuit is directed against registered traders or persons who do not have a general place of jurisdiction in Germany, or against persons who have moved their place of residence or usual place of abode abroad after conclusion of the contract, or whose place of residence or usual place of abode is not known at the time the lawsuit is filed. In these cases, the domicile of the provider shall be decisive.
